Terms of Service

    1. Agreement to These Terms

    By subscribing to WebEpic or using any part of our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before subscribing.

    If you do not agree to these Terms, do not use the service.

    2. The Service

    WebEpic provides subscription-based web development support. Depending on your plan, a dedicated developer is assigned to your account and made available to you via Slack to handle web requests across supported platforms including WordPress, Webflow, Shopify, Squarespace, Wix, Framer, Lovable, and other major no-code platforms.

    WebEpic is not an agency, a freelancer marketplace, or a ticketing service. The service operates as described on our website at the time of your subscription.

    3. Subscription Plans

    WebEpic offers two subscription tiers:

    Essential — $500/month
    Ongoing edits, updates, and basic no-code support. One project at a time. 2–3 business day turnaround per task.

    Pro — $2,000/month
    Full-site builds, advanced no-code development, site migrations, developer video calls, multiple simultaneous projects, and same-day turnaround.

    Pricing is as stated at the time of purchase. WebEpic reserves the right to change pricing with 30 days' written notice to existing subscribers.

    4. What Is and Is Not Included

    4a. Essential Plan — Included

    • Unlimited web requests (subject to fair use — see Section 7)
    • Simple edits and changes to existing websites
    • Basic no-code platform support
    • One active project at a time
    • Dedicated developer via Slack
    • 2–3 business day turnaround per task

    4b. Essential Plan — Not Included

    The following are available on the Pro plan only and are not included in the Essential plan:

    • New website builds from scratch
    • New page design (creation of net-new designed pages)
    • Custom code development (bespoke scripts, plugins, application logic)
    • Advanced no-code development
    • SEO audits, speed optimisation, or technical SEO implementation
    • Multiple simultaneous projects

    4c. Pro Plan — Included

    Everything in the Essential plan, plus:

    • Full-site builds
    • New page design
    • Custom code development
    • Advanced no-code support
    • Multiple simultaneous projects
    • Same-day turnaround
    • Site migrations
    • Developer video calls

    4d. Out of Scope for All Plans

    The following are not available on any WebEpic plan:

    • Custom software or application development
    • Mobile app development
    • Back-end server infrastructure, databases, or DevOps
    • Copywriting, content strategy, or marketing services
    • Graphic design unrelated to web implementation
    • Any work requiring access to third-party systems not related to your website

    WebEpic reserves the right to decline requests that fall outside the scope of the subscribed plan or that are otherwise not covered by these Terms.

    5. Dedicated Developer

    When you subscribe, WebEpic will assign a dedicated developer to your account. That developer will be added directly to your Slack workspace.

    WebEpic assigns developers at its sole discretion. If you are not satisfied with your assigned developer, you may request a swap. WebEpic will make reasonable efforts to accommodate such requests, but cannot guarantee a specific developer or an immediate reassignment.

    WebEpic reserves the right to reassign a developer at any time due to operational requirements. In that event, WebEpic will notify you and ensure continuity of service.

    6. Communication and Turnaround

    All work requests must be submitted via Slack. Requests submitted through other channels (email, phone, social media) are not guaranteed to be actioned.

    Turnaround times are targets, not guarantees:

    • Essential: 2–3 business days per task
    • Pro: same business day for tasks received before 12:00 PM AEST

    Turnaround times apply to individual tasks worked on sequentially. Complex tasks may take longer. WebEpic will communicate estimated timeframes where tasks exceed the standard turnaround.

    Business days exclude weekends and Philippine public holidays.

    7. Fair Use

    "Unlimited requests" means you may submit as many web requests as you need without being charged per request. It does not mean an unlimited simultaneous workload.

    The following rules apply:

    • Essential plan: one active task is worked on at a time. Additional requests queue behind the current task.
    • Pro plan: multiple tasks may be worked on simultaneously at the developer's discretion.
    • WebEpic reserves the right to pause, prioritise, or limit service to any client whose request volume is unreasonably high or whose usage pattern is inconsistent with the intent of the subscription model.

    WebEpic will contact you before taking any action under this clause and will work with you to find a reasonable resolution.

    8. Billing and Payment

    Subscriptions are billed monthly in advance on the date of first payment. Payments are processed via WebEpic's payment processor.

    All fees are non-refundable except as set out in Section 9 (Money-Back Guarantee) and Section 10 (Pausing and Cancellation). If your payment fails, WebEpic reserves the right to suspend your account until payment is received.

    You are responsible for providing accurate billing information and keeping it up to date.

    9. Money-Back Guarantee

    New subscribers may request a full refund within 7 calendar days of their first payment. To claim the guarantee, contact WebEpic via your Slack channel or by email within 7 days of subscribing. No conditions apply — if you're not satisfied, you get your money back.

    The money-back guarantee applies to first-time subscriptions only and cannot be applied to renewals or resubscriptions.

    10. Pausing and Cancellation

    Pausing: You may pause your subscription at any time. Unused subscription time is not forfeited — your billing cycle is paused and resumes from where it left off when you unpause. Pausing must be requested via Slack or email.

    Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refund is issued for unused days in the current billing period. After cancellation, you retain full access to the service until the end of the paid period.

    There are no lock-in contracts and no cancellation fees.

    11. Intellectual Property and Ownership

    All work product created by WebEpic on your behalf — including code, page layouts, design implementations, and configurations — becomes your property immediately upon creation. No additional payment or request is required to transfer ownership.

    You grant WebEpic a limited licence to access your website, hosting accounts, and connected platforms solely for the purpose of delivering the service.

    WebEpic does not claim any ownership over your website, its content, or any assets you provide.

    12. Access to Your Systems

    To deliver the service, your developer will require access to your website platform, hosting account, and potentially connected third-party tools (e.g. domain registrars, form providers, analytics platforms).

    By subscribing, you agree to:

    • Provide your developer with the access credentials or permissions they need to complete your requests
    • Take responsibility for the security of credentials you share, including using secure methods (e.g. a password manager or credential-sharing tool) where possible
    • Ensure you have the legal right to grant access to any system or account you share with WebEpic

    WebEpic personnel are bound by a confidentiality obligation. All access credentials and account information shared with WebEpic are treated as confidential and will not be disclosed to any third party except as required by law.

    WebEpic will not retain credentials beyond what is necessary to carry out your requests.

    13. Your Responsibilities

    You agree to:

    • Provide accurate, complete, and timely information to support your requests
    • Ensure you have the rights to any content (images, text, code, logos) you ask WebEpic to use or incorporate
    • Not use the service to build or support websites or content that is unlawful, deceptive, harmful, or in violation of any third-party rights
    • Treat WebEpic developers with professionalism and respect

    WebEpic reserves the right to terminate service immediately and without refund if a client engages in abusive, harassing, or threatening conduct toward any WebEpic developer or staff member.

    14. Limitation of Liability

    To the maximum extent permitted by applicable law:

    • WebEpic's total liability to you for any claim arising out of or related to these Terms or the service is limited to the amount paid by you in the one (1) month immediately preceding the event giving rise to the claim.
    • WebEpic is not liable for any indirect, incidental, consequential, or special damages, including lost profits, loss of data, or business interruption, even if WebEpic has been advised of the possibility of such damages.
    • WebEpic is not liable for any issues arising from third-party platforms (e.g. WordPress, Webflow, Shopify), platform outages, plugin conflicts, or changes made to your website by any party other than WebEpic.

    Nothing in these Terms excludes liability that cannot be excluded under applicable consumer protection law.

    15. No Warranties

    The service is provided "as is." WebEpic makes no warranty that the service will be uninterrupted, error-free, or meet every specific requirement. Turnaround times are targets, not guarantees.

    WebEpic does not warrant that any particular outcome (e.g. improved conversions, increased traffic, specific design results) will be achieved through use of the service.

    16. Non-Circumvention and Non-Solicitation

    By subscribing to WebEpic, you agree not to directly engage, hire, contract, or otherwise solicit the services of any developer assigned to your account — whether as an employee, contractor, freelancer, or in any other capacity — outside of the WebEpic platform, during your subscription and for a period of 12 months after your subscription ends.

    This applies regardless of whether the initial contact is made by you or by the developer.

    If you wish to engage a WebEpic developer directly, you must contact WebEpic first. WebEpic may, at its sole discretion, facilitate such an arrangement and will outline any applicable terms.

    In the event of a breach of this clause, you agree to pay WebEpic a placement fee equal to 3 months of the Pro plan subscription rate ($6,000 AUD or equivalent) as reasonable compensation for the loss of the developer relationship. This amount represents a genuine pre-estimate of loss and is not a penalty.

    WebEpic reserves the right to pursue additional remedies available under applicable law.

    17. Confidentiality

    Both parties agree to keep confidential any non-public information shared in the course of the service relationship. This includes business information, strategy, credentials, and any materials shared by the client to enable delivery of work.

    This obligation survives termination of the subscription.

    18. Termination by WebEpic

    WebEpic reserves the right to suspend or terminate your account if:

    • You breach these Terms and fail to remedy the breach within 7 days of written notice
    • Your conduct is abusive, threatening, or harmful toward any WebEpic developer or staff
    • Payment is not received after reasonable notice
    • Your use of the service is found to be unlawful or causes harm to a third party

    In the event of termination by WebEpic for cause, no refund will be issued for the current billing period.

    19. Changes to These Terms

    WebEpic may update these Terms from time to time. If we make material changes, we will notify you via Slack or email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

    The current version of these Terms is always available on the WebEpic website.

    20. Governing Law

    These Terms are governed by the laws of the jurisdiction in which WebEpic is incorporated. This section will be updated upon formal incorporation. In the interim, any disputes will be resolved in good faith between the parties before any formal proceedings are initiated.

    21. Entire Agreement

    These Terms, together with any order confirmation or subscription details provided at the time of purchase, constitute the entire agreement between you and WebEpic with respect to the service. They supersede any prior agreements, representations, or understandings.
